高等法院於二○二二年十月二十一日頒下關於新冠疫苗接種醫學豁免證明書（豁免證明書）司法覆核的判詞。政府經仔細考慮法律意見、抗疫工作的迫切性、各持份者及公眾利益等因素後，決定對有關案件不提出上訴，並會透過修訂相關規例，為有關指示提供清晰的法律基礎。
一如以往，政府依法行事，並確保政府的施政及行為有清晰法律授權。香港法例第599章《預防及控制疾病條例》及其規例授權政府可為防止、應付或紓緩公共衞生緊急事態的影響，及為保障公眾健康，訂立規例。有關規例涉及不同範疇及影響社會各個階層，並且針對隨時變種的病毒及疫情，因此使用比較概括的條文，以達到最大的效果，這亦合乎整體公眾利益及照顧市民健康所需。
當政府發現有私家醫生涉嫌未有按照衞生署指引為病人恰當診症並濫發豁免證明書後，政府認為必須迅速應對，因為市民若繼續按照相關醫生在豁免證明書的建議而延誤接種，可能對自身構成健康風險。他們一旦感染新冠病毒，可導致重症甚至死亡，亦會對公營醫療系統帶來不必要的負擔。因此政府根據《預防及控制疾病（疫苗通行證）規例》（第599L章）及《預防及控制疾病（規定及指示）（業務及處所）規例》（第599F章）發出指示。政府亦同時作出便利的安排，讓有關市民可免費及盡快於醫院管理局普通科門診諮詢公營醫療系統醫生，由醫生按其身體狀況進行臨床評估，以確定他們能否繼續獲得醫學豁免。
法庭在考慮與訟雙方的證據及陳詞後，裁定有關法律條文未有授權政府不接納任何人士以涉事的豁免證明書作為「疫苗通行證」。政府參考了法律意見，考慮到防疫工作的急切性，上訴所涉的訴訟時間和有關豁免證明書的有效期限，認為最合適的做法是作出修例而非作出上訴，這符合香港的最佳利益。
政府今日（十月二十五日）刊登憲報，訂立《2022年預防及控制疾病（疫苗通行證）（修訂）規例》（《修訂規例》），提供清晰法律基礎，處理懷疑個別醫生在未有遵照衞生署指引為病人進行臨床評估的情況下所發出的豁免證明書，從而維持「疫苗通行證」制度的完整性及穩健度。政府明日（十月二十六日）將向立法會提交《修訂規例》進行「先訂立後審議」程序，《修訂規例》同日生效。
具體來說，《修訂規例》賦權醫務衞生局局長（局長），當有合理理由懷疑某註冊醫生發出豁免證明書前未有進行臨床評估，可宣告特定的豁免證明書失效。此外，局長亦可以基於公眾利益的考量，宣告某註冊醫生發出的所有指明豁免證明書失效。局長在宣告某註冊醫生所發出的指明豁免證明書失效前，須考慮所有相關因素，包括（但不限於）「疫苗通行證」制度是否出現紕漏或其穩健性有否受損；有關註冊醫生在發出豁免證明書前有否為病人進行臨床評估，和該醫生在特定時間內發出豁免證明書的數量、模式和方式；以及衞生署署長的意見等。
此外，《修訂規例》亦把《預防及控制疾病（疫苗通行證）規例》（第599L章）的有效期延長六個月，即由二○二二年十二月三十一日午夜延長至二○二三年六月三十日午夜。 -
